Intoxicating Cannabinoid Control Code (ICCC) | STL County Bill 15

The safest and simplest approach to protecting Missourians – including children– from the dangers of unregulated, intoxicating THC products is for legislators to pass the ICCC – STL County Bill 15.

Law enforcement and child advocates from across the state are calling for the passage of the Intoxicating Cannabinoid Control Code (ICCC), introduced as Bill 15 by Councilwoman Lisa Clancy.

The legislation is very straightforward. Hemp and marijuana come from the same plant. The ICCC clarifies that if a product comes from a cannabis plant and is intoxicating, itʼs marijuana and Missouri law should treat it as such. The ICCC is the seamless, inexpensive way to integrate unregulated cannabinoid products, such as Delta-8 THC, into Missouriʼs existing regulatory framework for marijuana.

The ICCC mandates that these products be lab-tested for safety, sold in childproof packaging, and taxed as marijuana products.

MYTH

Regulating intoxicating hemp-synthesized products will cost MO jobs and close stores.

FACT

Sales of these products account for less than 3% of c-store sales.

These products are almost exclusively made and grown outside of Missouri, and increasingly overseas in countries like China.

MYTH

The 2018 Farm Bill allowed these products, therefore they should be readily available in MO.

FACT

The 2018 Farm Bill does not authorize these synthetic intoxicants.

The 2018 Farm Bill congressional record is littered with references to deregulating industrial hemp as an agricultural commodity. The record does not reference or discuss deregulating synthetic consumer facing intoxicants. Indeed, the record reflects the reason Congress deregulated industrial hemp is because it is non-intoxicating.

Even supporters of Delta-8 acknowledge that these products were never intended to be legalized in the Farm Bill. Law enforcement and health care leaders agree that we canʼt wait around for Congress to close the Farm Bill loophole but instead need pro-public safety lawmakers to pass the ICCC.

MYTH

This will just add to the marijuana monopoly in MO.

FACT

MO voters expect intoxicating marijuana products to be highly regulated and only available through DCR licensed facilities.

More than 500 small businesses make up the Missouri cannabis industry, which last year generated more than $241 million in sales tax revenue for Missouri veterans, substance abuse programs, our public defender system and local communities all around the state.

If the hemp industry is allowed to continue to sell unregulated and untested products, the sustainability of the regulated system will be jeopardized.
